Terms and Conditions

Scope and limitations of liability

In this document we will cover it for the websites developed or managed by Axiacore.

Integrity and operation of the websites

Axiacore is fully responsible for the integrity and proper functioning of the website developed, managed, or where any type of work / intervention is entrusted to it, as long as:

  • Axiacore provides the support service.
  • Axiacore has the exclusivity of all administrative access to the server and the website (infrastructure, database, CMS administrator, etc.).
  • Axiacore assumes the administration of the platform to carry out updates and maintenance with the inclusion of periodic backups.

In any other situation, we consider that the person responsible for the website is the client or whoever he designates for it.

Websites hosted on third-party servers

When the client has and uses a hosting service contracted to third parties (not provided by Axiacore), after finishing and delivering or publishing any web development or programming work, Axiacore is not responsible for future failures, malfunctions or errors in the site. website, for whatever reason.

Possession of the access to the server or website

When it is not possible for us to have exclusive access to the client's server and the website administrator, we lose control over the integrity of the website in question and its proper functioning, therefore we disclaim any responsibility in this regard. Any intervention that is requested of us to repair eventual failures, errors or inconveniences, will have an extra cost. In the case where the client assumes or previously has the administration of the website where Axiacore performs any work, he must change all access passwords delivered to Axiacore (after the final delivery of the work or the publication of the website), to ensure this exclusion of our liability.

Backup policy and data protection

We also recommend making and keeping up-to-date backups of the web sites or systems where third parties must access or work. The client must always have an up-to-date backup copy of his website or contract a web administration service that includes periodic backups. Axiacore performs a back up of the websites developed at the time of delivering the finished work to the client, but it must be considered that this initial back up does not contemplate subsequent updates of the website, so it is very important for the client to define and decide how manage your backups, especially on websites that will be constantly updated and/or where data storage is critical. In case of fortuitous events that cause the loss (partial or total) of data or other resources owned by the client on the web server (hacker attack, hardware failure, etc.), Axiacore is not responsible. This includes both the website and any type of documentation/files hosted on the server.

Legal responsibility for the contents

The client is the owner of the website whose development or administration is entrusted to Axiacore. From a legal point of view, the owner of the website is responsible for the contents and publications on it, as well as being responsible for compliance with current legislation that regulates the uses and conditions of Internet sites, in those areas locations where applicable.

Corporate image of the client

Axiacore is not obliged to include logos, brands or colors in the developments made to the client. The client may use its own logo, brands and colors, if duly provided to Axiacore prior to the start of the project.

Changes to the service

Axiacore may, at its discretion, modify, improve and/or expand the features of the service at any time without incurring additional costs to the Customer. Axiacore may also, at any time, make additional features and/or functionality available to a service, which may incur additional cost to the customer. If the customer decides to add such an enhancement to their service, they may do so in agreement with Axiacore.

Cost adjustments

Axiacore may, prior written notice of at least 30 days prior to the initiation or renewal of the service, adjust the costs paid for the service, allowing the customer a period of 15 days from the delivery of the written notice by Axiacore, either for modify the amount or type of service used by the client, or terminate work orders, prior written communication, before the next renewal period. This applies to periodic provision services.

Training and support

Training and support provided by Axiacore, if applicable, are specified in the service description. The support work regarding software changes and/or improvements requested by the client will be subject to an evaluation by Axiacore to verify its feasibility and relevance within what is described in the "Business Proposal", which will be notified to the client. indicating whether or not the request incurs additional costs. All the support provided is regulated mainly under the Service Level Agreement, except for some explicitly agreed exceptions.

Term for breach

Either party may terminate any Service and/or this Agreement by written notice to the other party if the other party is in breach of its obligations under this Agreement and such breach is not remedied within sixty (60) days after notification by the other party.

Cancellation of the service

Axiacore or the customer may cancel a service at the end of any (start-up or renewal) by notifying the other party of their interest in writing at least 30 days prior to such termination date.

Promotional use of client name

Customer agrees that Axiacore may use its name, logo and brand to identify them as a customer of Axiacore for use and reference in promotional and marketing material. Customer agrees that Axiacore may create press releases identifying them as an Axiacore customer describing Customer's experience of use and the benefits Customer receives from using the Service. The content of any press release identifying the client as a client of Axiacore may be subject to prior approval by the client, which may not unreasonably deny publication.

Information in the website

The client is responsible for all uses of the service, in turn, is responsible for preserving the confidentiality of your user account and password, and all information related to it. Customer agrees to immediately notify Axiacore of any unauthorized use of its account that Customer has detected.

The customer acknowledges his sole responsibility for all multimedia or written content stored in his account. The client agrees that he will not use the services provided by Axiacore to send unsolicited emails or with the intention of violating current laws. Customer agrees that it will not use the Services to send any message or material that is harassing, defamatory, threatening, obscene, violates any party's intellectual property rights, is illegal, gives rise to civil liability, or constitutes or encourages conduct that results in a criminal offense, under any applicable law or regulation. Although Axiacore is not responsible for any such communications, Axiacore may suspend Customer's service at any time upon communication with Customer.

Privacy

Axiacore uses a variety of security measures, including sophisticated encryption and authentication methods, to keep information secure. Customer information is stored on secure networks and is only accessible to a limited number of people who have special permissions on such systems, and are required to keep the information confidential. Despite best efforts, no data transmission over the Internet can be guaranteed to be 100% secure.

Limited Warranty

CUSTOMER UNDERSTANDS AND AGREES THAT THE ASSOCIATED SERVICES AND ANY SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AXIACORE EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ARISING OUT OF FAILURE TO TIMELY REPORT FAULTS OR ERRORS IN THE SERVICE. THE USE OF THE SERVICES IS AT THE CUSTOMER'S OWN RISK, WHO IF USING HIS OWN HARDWARE CONFIGURATION IS ENTIRELY RESPONSIBLE FOR FAILURES NOT DERIVED FROM THE SOFTWARE. THE CUSTOMER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES OR LOSSES ARISING FROM THE INCORRECT USE OF THE SERVICES. AXIACORE DISCLAIMS ANY WARRANTIES FOR THIRD PARTY MODIFICATION OF THE SOFTWARE DEVELOPED BY AXIACORE, OR FOR CHANGES MADE TO PERFORM MIGRATION OR VALIDATION AFTER THE FORMAL DELIVERY OF THE SOFTWARE TO THE CUSTOMER.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AXIACORE, ITS AFFILIATES OR ITS SUPPLIERS BE LIABLE FOR SPECIAL, INCIDENTAL, INDIRECT, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST REVENUES, INTERRUPTION OF BUSINESS, LOSS OF BUSINESS INFORMATION, OR ANY ASSOCIATED LOSS) INCLUDING BUT NOT LIMITED TO CLAIMS ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE OR ASSOCIATED SOFTWARE, EVEN IF AXIACORE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, THE MAXIMUM CUMULATIVE LIABILITY AND FOR ANY CLAIM RELATING TO THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THE USE OF THE SUPPORT SERVICE IN THE PRECEDING 12 MONTHS, EVEN IF ANY KIND OF NEGOTIATION FAILS.

Account information

Axiacore is not the owner of any data, information or material that is used in the provision of the service. You, not Axiacore, have sole responsibility for the accuracy, quality, integrity, legality, and intellectual property or right to use of your account information, and Axiacore will not be responsible for the deletion, correction, destruction, damage, or loss of such information. In the event this agreement is terminated, Axiacore will provide you with a file of customer information within 30 days of termination if requested in writing by the customer at the time of termination. Axiacore reserves the right to retain, withdraw and/or discard customer information without prior notice, including, without limitation, your non-payment for services. Upon termination, your right to access or use the Services ceases immediately, and Axiacore will have no obligation to maintain or provide Customer Information.

Timely bug reporting

The client will inform Axiacore in a timely manner of any error or failure that occurs in the provision of the service, for which Axiacore will determine the most appropriate means for such purpose, and to which the client must adhere without the right to waive it. Customer acknowledges that failure to promptly report failures or errors will not result in Axiacore accepting any liability arising out of or caused by such failure. Therefore, Axiacore must be notified in writing of any failure.

Confidentiality

This confidentiality clause has the purpose that between the contracting parties, by virtue of the functions that it exercises, they keep absolute secrecy about the information that it handles or that it may manage in the exercise of the same, mainly in relation to the databases of suppliers, customers, personnel and other possible parties involved in what is described in the business objects, databases and lists of supplies and raw materials, production processes, production methods, strategy methods, marketing and models of business, know-how, copyright, technology and others related to the description of the business.

A. Information

On the occasion of this agreement and what is stated in it, the contract provides and uses "CONFIDENTIAL INFORMATION" related to the client's business. Said "CONFIDENTIAL INFORMATION" for the purposes of this agreement is defined as any secret, technical or information that means obtaining or maintaining a competitive or economic advantage over third parties in the performance of economic activities and with respect to which it has preserved its confidentiality and the restricted access to it, which in a non-limiting way includes:

Information embedded in computer software or included in electronic storage media, as well as information contained in documents, magnetic media, optical discs, microfilms, movies, or other similar media.

Information revealed orally or in writing, related to the activity of the client in relation to the technical, economic, commercial, legal and fiscal feasibility studies, among others, of carrying out "the business", as well as "the business" same and negotiations related to it.

All information, works, reports, programs, studies, among others, generated by Axiacore for the work it performs on behalf of the client related to the technical, economic, commercial, legal and fiscal feasibility, among others, of carrying out "the business", as well as "the business" itself and negotiations related to it. The parties agree that all the information referred to in this subsection is the property of the client.

That due to "the business", the client and Axiacore agreed that the latter carry out work for which the client will need to transmit "CONFIDENTIAL INFORMATION" to Axiacore, on a regular basis, so that the latter applies it or make use exclusively for the development of its entrusted work.

B. Obligations

The client, when necessary, will provide Axiacore with the "CONFIDENTIAL INFORMATION" that it requires so that it may consider it when carrying out its entrusted tasks, in favor of the client, related to the technical, economic, commercial, legal and fiscal feasibility, among others, of conduct "the business" as well as about "the business" itself. Likewise, Axiacore, under the same terms mentioned above in this clause, will provide the information to the client in the manner described above.

Axiacore starting from the start date of work, undertakes with the information of the client, not to dispose of it, lease it, lend it, record it, negotiate it, reveal it, publish it, teach it, make it known, transmit it or in any other way disclose it or provide it for any means, even when it comes to including it or delivering it in other documents such as studies, reports, proposals or offers, neither in whole nor in part, for any reason to companies of which Axiacore is a shareholder, advisor, successor in title, attorney in fact, director, commissioner , holder of shares and, in general, have any relationship of any kind by themselves or by third parties.

Axiacore expressly agrees that it may not exploit or use, in any case, the "CONFIDENTIAL INFORMATION" for itself or for its own purposes. Axiacore assumes the obligation not to reveal the "CONFIDENTIAL INFORMATION" for the validity of the confidentiality clause.

The obligation not to dispose of, lease, lend, encumber, negotiate, reveal, publish, teach, publicize, transmit or in any other way disclose or provide to any natural or legal person, national or foreign, public or private, present or future, by any means, the "CONFIDENTIAL INFORMATION" provided for in this contract extends to its partners, directors, legal representatives, directors, managers, advisors, dependents and other natural or legal persons related to Axiacore, for which the latter undertakes to commit the persons referred to in this paragraph to the fulfillment of this contract and, in the same way, not to refer to the "CONFIDENTIAL INFORMATION" in public or in private, regardless of the purposes of the exhibition, whether it is a chair, conference or any other means, regardless of whether or not said lectures or conferences or other means are paid.

By virtue of the foregoing, it is understood that Axiacore must ensure that each receiver of information mentioned in the preceding paragraph adheres to the confidentiality commitment provided for in this contract.

All the information, techniques, methods, procedures and strategies in the development of the business that Axiacore possesses will be understood as part of Axiacore's know-how, and therefore belongs exclusively to it, from the moment of acceptance of these terms and conditions.

The contracting parties acknowledge and agree that all information related to "the business" is at all times the property of the client, therefore Axiacore agrees to observe in this regard the provisions of this document.

The client may claim or request the return of the "CONFIDENTIAL INFORMATION" at any time by means of a communication made to Axiacore.

Axiacore must return, within THIRTY (30) days following the date on which it receives the communication, the originals, copies and reproductions of the "CONFIDENTIAL INFORMATION" that it has in its possession as well as that which is in the possession of persons to whom it which the "CONFIDENTIAL INFORMATION" has been disclosed to them.

C. Authorizations

The client must give prior written authorization to Axiacore in case it is the client's wish, or Axiacore's need to disclose all or part of the "CONFIDENTIAL INFORMATION" to a third party.

The client may deny said authorization without expressing any reason. If the client grants written authorization, they will sign a confidentiality agreement with the third party for this purpose, prior to Axiacore providing all or part of any "CONFIDENTIAL INFORMATION" to the third party, in order to which Axiacore must verify before disclosing the "CONFIDENTIAL INFORMATION" if indeed the client and the third party signed the corresponding confidentiality agreement.

D. Validity

The validity of the confidentiality clause will be for the duration of the contracted work and/or while the client has some type of legal or economic relationship with Axiacore or its subsidiaries or entities, and TWO (2) more years.

Telemetry and Anonymous Data Collection

Axiacore may collect and use telemetry data from our software products for the purpose of improving and enhancing their performance and functionality. This data is collected anonymously and does not personally identify any user.

Information Collected:

  • Interactions (e.g., transactions, conversions) and their monetary value.
  • Device information (e.g., device type, operating system).
  • Usage data (e.g., features utilized, frequency of use).
  • Error logs and performance metrics.

Purpose of Data Collection:

The collected data is used for analytical and diagnostic purposes to identify areas for improvement, troubleshoot issues, and enhance the overall user experience and product value.

Opt-Out Option:

You have the option to opt-out of telemetry data collection at any time. To exercise this option, please contact us at info@axiacore.com.

Third-Party Services:

We may use third-party analytics services to assist in the collection and analysis of telemetry data. These third parties are bound by confidentiality agreements and are prohibited from using the data for any purpose other than improving our products.

Security Measures:

Web development service contracts

When Axiacore makes closed proposals and quotes, service contracts are constituted. These generally include:

  • Deadlines for budgets and proposals.
  • Resources, data, and materials to be provided by the client.
  • Resources to be developed/provided by Axiacore as part of the proposed service.
  • Deadlines for delivery of materials and content by the client (counted from the effective contracting of the service).
  • Deadlines to make the corresponding payments and their means.
  • Project managers (on behalf of Axiacore and the client).
  • Items and services included in the budget.
  • Credits for development work and/or mentions in the Axiacore portfolio.
  • Licenses for the use of copyrighted materials (copyright).
  • Warranties, limitations and scope of the products, resources, and software used for the provision of the service.
  • Maximum allowed number of revisions/corrections to the deliverables and their allowed level of complexity.
  • Deadlines for corrections and revisions of the deliverables.
  • Guarantees, limitations and scope of the work or services performed.
  • Conditions to regulate non-compliance with deliverables (by both parties: Axiacore and the client).
  • Project completion and delivery deadlines.
  • Post-sale support.
  • Other agreed conditions.

Support service

Websites delivered to the client: punctual adjustments and monthly administration plans.

Specific adjustments

We call "adjustment" any type of task requested by the client that requires Axiacore's work time. Each adjustment has a fixed cost and is paid only once. The cost is charged in units of hour or fraction.

Support requests will be answered within 48 hours on business days.

Monthly support service

The monthly assistance service is contracted under specific commercial terms for each project.

The assistance is made up of several activities that seek to preserve the continuity of the business in the portals, carrying out security updates, audits, maintenance and other activities that are defined for each project, this in order to provide a higher level of peace of mind for our clients.

Work contracted by the hour

The client must send a complete, exhaustive and precise written detail of their requirements, also specifying the work to be carried out, the URL of the website and its corresponding accesses. In addition, you must deliver any resource, material, content, or files necessary to carry out the commissioned work.

Once we evaluate the request, if it is feasible to provide the service, we will do a projection of the number of hours necessary (approximate) to do work. Those hours is not a commitment from Axiacore to do the work in that time, at the end Axiacore will charge the hours actually worked. In this service the client is hiring the hours of work of a professional, not a scope.

When the client agrees the service begins to be provided.

Components used in software development

The websites developed or built by Axiacore use open source components, for which it is always necessary to refer to the license of each component in particular, for the code used especially in the projects of each client, rights are solely of the client who hires them and not from Axiacore.

Licenses

Clients who contract services with Axiacore accept the terms of use and licenses of the components used in their projects.

The licenses for each component used in the projects can be found as part of the source code delivered at the end of each project.

Software Warranties

Axiacore has tools that allow the client to constantly monitor progress in the development of its application via the web and actively participate, prioritizing the activities it considers most relevant. All the software that Axiacore develops goes through a testing environment that minimizes errors and allows traceability of the application, however Axiacore exempts the client from possible consequences caused by risks inherent in the development of web applications, providing a guarantee on the work carried out and ensuring timely support in case of failures. However, it should be noted that:

The guarantee only covers programming errors, under no circumstances does it cover changes in logic, degradation in response times, security updates, software version updates, project stability assurance (uptime) or disputes on previously approved functionalities.

The components used in the projects developed by Axiacore are provided "as is" without any guarantee, although the components are extensively tested and used, it is probable that they may present faults.

The use of open source dynamic web systems requires knowing that there are potential security vulnerabilities, small flaws / non-critical errors (bugs) in their programming, or limited technological compatibility.

IN NO EVENT SHALL AXIACORE BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS DATA, OR OTHER LOSS OF DATA OR MONETARY) ARISING OUT OF USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Technological compatibility with infrastructure

The infrastructure where Axiacore's projects are carried out must meet the established technical requirements.

The client knows and accepts that if his web server does not support these requirements, the software may not work or work partially. This is beyond the responsibility of Axiacore, in which case it can provide the hosting service that meets these requirements, or the customer has the option of hiring a compatible web server on their own when requesting the installation of the software.

Compatibility in web browsers

Fonts, colors, and other elements may look different depending on the operating system. Mobile device support is limited and may not offer functionality available on desktop devices.

Software updates

Any type of software update that must be done on any website is a job whose cost is assumed by the client. Software updates must be carried out on average every 3 months, otherwise security risks or technological obsolescence are incurred.

Third party software

When implementation of software developed by third parties is necessary, Axiacore will evaluate, test and make recommendations on their use but cannot absolutely guarantee the correctness of their operation in all circumstances, states and situations, nor can they be guaranteed to be error-free, bugs or security vulnerabilities.

Most of the authors and developers of applications deliver their software versions "as is" and do not offer guarantees on these products, except under specific conditions where the technical requirements detailed in their license coincide with those actually implemented.

The use of free extensions sometimes does not include any type of technical support from their authors / developers. In the commercial extensions, their authors offer technical support -of different scopes and limitations- via email, forums, or ticket systems.

Licenses for the use of graphic material, multimedia and content acquired with copyright (royalty free)

In those cases where Axiacore must buy creative content for the development of the website, such as photographs, templates, videos, music, etc, these elements will be acquired in a "royalty free" mode (exempt from royalties), that is, free of payment of licenses in perpetuity, under certain particular conditions.

License payments are made at the time of purchase of these contents by Axiacore from the author or authorized reseller, to then assign these rights of use to the final customer, owner of the website.

Axiacore does not use illegally acquired material or software, nor does it infringe copyright.

Generally, these conditions of use of "royalty free" content or elements limit the sale, resale, and distribution of the licensed elements, as well as the creation of works derived from these elements for sale, resale, or distribution.

All elements, content, and materials licensed as royalty free do not possess or confer to the client the exclusive right of use, nor the power to limit the use to other licensees.

Consulting services, support, or online training

Remote assistance

The appointments to develop the consulting or training sessions agreed between the consultant and the client must always be on the days and times available for this service.

Consulting, support or training sessions have a minimum duration of one hour and are recorded as an hour or fraction.

All the time used by the consultant to provide the consultancy is accounted for and charged. Loss of time attributable to the consultant's own issues will ALWAYS be compensated to the client. The loss of time attributable to customer issues, except for reasons of force majeure, are the sole responsibility of the customer.

In case of having to postpone an agreed session, it must be notified 24 hours in advance. Except in cases of force majeure, each scheduled session where the client does not attend without having notified its cancellation, is inevitably lost.

Requirements for remote assistance

The client must have a minimum Internet connectivity of 100 mbps. To take this type of support, the client must have their equipment and programs configured and ready to establish communication.

During the session, the time spent configuring audio devices or programs will be counted as part of the billed time.

Support

Axiacore has tools that allow the client to monitor constantly via the web of the progress in the development of your application and actively participate prioritizing the activities that you consider most relevant. All the software that Axiacore develops goes through a testing environment that minimizes errors and allows traceability of the application, however Axiacore exempts the client from possible consequences caused by risks inherent in the development of web applications, providing a 60-day guarantee on the work done and ensuring timely support in case of failures.

However, it should be noted that support does not include any additional software development, performance adjustments or optimizations, or logical changes to the software components. Changes in texts or adjustments that do not imply a major change may be made, this is at the discretion of Axiacore when a change is considered major.

Website hosting service

Scope of service support

The hosting service is not self-managed, nor does it offer a control panel (Cpanel). The administration of the services under the contracted account on the web server is the responsibility of Axiacore, which will be able to manage all the maintenance tasks and necessary configurations.

The passwords used must be "secure" (strong), the security level of the passwords is the responsibility of the client.

The inappropriate use of access passwords (use of easily guessed passwords or disclosure of the same) and the consequences arising from this misuse is the responsibility of the client.

In case the client wants to manage his server with another provider or on his own account, he is free to do so, as long as he understands that it is under his own responsibility.

When the client requests it, the following tasks have an associated cost (unless the assistance plan is contracted):

  • Database backups.
  • Source code and file backups.
  • Monitoring on the server.
  • Portal performance improvements.
  • Security updates.
  • Advise on new developments.
  • Changes on existing functionalities.
  • Creation of new sections.
  • Design changes.
  • Reports.
  • Training.
  • Any request outside the warranty period.

Improper uses of the hosting service

Improper use of the web server is not permitted. "Improper use" should be understood as that which includes at least some of the practices or uses that we detail below:

  • SPAM. The practice of e-mail spamming is not allowed. this is sending spam to third parties.
  • Illegal content. sites that violate legal laws, or are morally undesirable: eg. pedophilia, illegal trafficking of prohibited goods, illegal businesses, advocacy of discriminatory ideologies, etc.
  • hacking practices. It is not allowed to use our server as a means of: automated web scanning, spoofing, hijacking, exploiting, dos (denial of service), sniffing, or other known techniques of illegal interference with data or resources owned by third parties. It is not allowed to host or use scripts (such as backdoors, Trojans), and in general any software program that accesses other domains / web servers for the aforementioned purposes.
  • Excessive use of server resources. This includes processes that overload the cpu and make excessive use of its ram memory, due to the use of poor software programs, or non-optimized databases.
  • Third-party copyrighted material: pirated software or copyrighted digital material is not allowed to be hosted on the web server when you do not have the appropriate permission to use and exploit it.
  • As a general rule, any improper practice or use of the service that harms our server or third parties is not allowed.

In the event of violation of these conditions or misuse detected in accounts hosted on the server, the service is automatically terminated, without the customer's right to refunds their money.

Backup of files and data owned by the client on the web server

It is the client's responsibility to maintain and safeguard complete and up-to-date backup copies of the information, data, and files hosted on the server. In general, this applies to any resource/configuration hosted on the server, owned by the client.

In the event of any loss or corruption of files or data, partial or total, for whatever reason, the recovery of lost and/or damaged resources or material will not fall on the service provider (Axiacore). Additionally, the client can request Axiacore the backup service, to ensure the integrity of the files and/or hosted website.

Conditions of cancellation of the accommodation service

The client can request the cancellation of the service at any time, but will not have the right to ask for refunds or money back for the remaining unused period of service.

Upon cancellation of the service by decision of the client (or due to lack of response to expiration messages), the client is solely responsible for recovering all configuration, data and files hosted on the server associated with their account. With this you will have at your disposal everything you need to start migrating your information and other resources you own to a new provider.

The management and work necessary to migrate resources owned by the client (website, data, email accounts, files, and server settings) from the server managed by Axiacore to another provider, are the responsibility of the client.

Any work required to perform the migration to another provider will be budgeted and charged to the customer.

Payments and service suspensions due to non-payment

Payment for the accommodation service is made in advance. The account associated with the service is managed by our account management system.

The first expiration notice is sent 30 days prior to the expiration date, together with a payment order for its renewal. In case of no response, our system will send 2 more notices in periods of 7 business days each (in total there are 3 due/payment notices).

The client must proceed to pay for the service and notify Axiacore, or alternatively request the cancellation of the service. Interest for late payment of the service applies from the expiration date of the service, in case the corresponding payment has not been made.

15 days after the expiration of the service, if we have not received any response from the client and/or the payment for the service, we will proceed to SUSPEND the account on the server, with the consequence that the website will be offline. In this instance, to restore the service, the client must pay an additional charge for REACTIVATION.

After 30 days of the suspension of the service, the account is deleted. We proceed to DELETE suspended accounts from our server after they have 30 days or more of inactivity.

All the files that make up the website as well as the data, configurations, and resources owned by the client are deleted, without the client having the right to make claims of any kind for the restitution or recovery of the deleted resources. Likewise, accounts whose associated domains have been delegated to other servers, without the client notifying Axiacore, will be deleted.

Right to modify terms and conditions

Axiacore reserves the right to add to or modify these terms and conditions, at any time and without prior notice. Likewise, we reserve the right to modify the scope, prices, and characteristics included in the products offered, at any time and without prior notice. Each contract will be governed by the conditions accepted at the time of its approval.
